Terms of use
These Terms of Use (“Terms”) apply to TreesideFinancial.com and any related websites, landing pages, forms, quizzes, calculators, scheduling tools, chat features, and other online services that link to these Terms (collectively, the “Site”). The Site is operated by Treeside LLC d/b/a Treeside Financial (“Treeside,” “we,” “us,” or “our”).

By accessing or using the Site (including any advertisement, form, quiz, chat, or application), you agree to these Terms and our Privacy Policy (together, the “Agreement”). If you do not agree, do not use the Site.
1. Eligibility and access restrictions
You must be at least 18 years old to use the Site. We may deny, suspend, or terminate access to the Site for any reason.
2. Important notices about the Site and mortgage information
The Site may include educational content, tools, and information about mortgage products and related services.
- Site information is for general informational purposes only.
- Nothing on the Site is a commitment to lend, a rate lock, an underwriting approval, or a guarantee of pricing, terms, or program availability.
- Products, rates, and programs are subject to change and may not be available in all states.
Treeside is a mortgage brokerage. Depending on your situation, we may help you submit an application to one or more wholesale lenders and work with service providers (such as title, insurance, verification vendors, and credit reporting vendors). We do not control third-party decisions, offers, or terms.
3. Acceptance of Terms and updates
We may update these Terms at any time by posting a revised version on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.
4. Authorization to access consumer information (soft-pull credit)
By submitting information through the Site (including any form, quiz, chat, or appointment request), you provide written instructions and expressly authorize Treeside and its partners, affiliates, lenders, brokers, and service providers (collectively, “Associated Parties”) to obtain and use consumer information about you, including soft-pull credit reports, consumer reports, credit attributes, and/or credit scores, from third parties and consumer reporting agencies.
You understand and agree:
- A soft-pull credit inquiry is intended for prequalification, verification, and matching purposes and typically does not affect your credit score.
- Your authorization allows Treeside and Associated Parties to obtain such information as reasonably necessary in connection with your inquiry.
- You represent that the information you submit is accurate and that you are the person identified by the information submitted (or you are authorized to submit it on that person’s behalf).
If you do not want us to obtain a soft-pull credit report, do not submit prequalification requests through the Site.
5. Consent to share information and be contacted
By submitting your information through the Site, you authorize Treeside to:
- Use your information (and, when authorized, consumer report data) to evaluate your request, provide services, and help match you with potential mortgage options.
- Share your information with Associated Parties as needed to provide requested services and/or potential offers.
- Contact you directly, or allow Associated Parties to contact you, using the information you provide.
Contact methods (calls, texts, email)
You agree that Treeside and Associated Parties may contact you, as permitted by law, by:
- Telephone calls (including automated technology where permitted)
- SMS/text messages
- Postal mail
Your consent to be contacted is not a condition of purchase, except as permitted by applicable law for the services you request.
Opt-out
You may opt out of marketing communications at any time:
- Email: use the unsubscribe mechanism (if provided)
- Text: reply STOP (or follow the instructions provided)
- All methods: contact us using the information in the Contact section
Opting out of marketing communications may not stop service-related communications (for example, messages about appointments, application status, or required disclosures).
6. Privacy Policy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Electronic communications and E-SIGN
You consent to receive communications from us electronically (for example, by email, text, or by posting notices on the Site), and you agree that electronic communications satisfy any legal requirement that such communications be in writing.
If we provide an electronic consent process for disclosures or applications, you agree to follow the instructions provided and to maintain accurate contact information.
8. Intellectual property; limited license
The Site and all content (text, graphics, logos, icons, images, audio, video, software, code, design, and compilations) (collectively, the “Materials”) are owned by or licensed to Treeside and protected by applicable intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site and Materials for your personal, non-commercial use.
You may not, without our prior written permission:
- Copy, reproduce, distribute, publish, sell, license, publicly display, or create derivative works from any Materials
- Modify, decompile, reverse engineer, or attempt to extract source code from any part of the Site
- Remove proprietary notices
- Use the Site or Materials for any commercial purpose
9. Hyperlinking, co-branding, framing, and referencing restrictions
Unless expressly authorized in writing by Treeside, you may not:
- Link to the Site in a manner that suggests affiliation or endorsement
- Co-brand, frame, mirror, or embed the Site or its Materials
- Use Treeside names, trademarks, branding, or copyrighted content without permission
You agree to cooperate with us to remove or disable any unauthorized linking, framing, or use upon request.
10. User conduct
You agree to use the Site only for lawful purposes. You may not:
- Misrepresent your identity or submit information you are not authorized to provide
- Harass, abuse, or interfere with other users
- Attempt to gain unauthorized access to systems or data
- Introduce malware, viruses, or other harmful code
- Scrape, data-mine, or harvest information from the Site without permission
11. Submissions and feedback
If you submit feedback, testimonials, suggestions, or other non-confidential materials (“Submissions”), you grant Treeside a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display those Submissions for business purposes.
Personal information you submit (such as your name, phone number, email, or application data) is handled under our Privacy Policy.
12. Third-party links, tools, and services
The Site may include links to third-party websites, tools, advertisements, or services. We do not control and are not responsible for third-party content, accuracy, availability, security, or privacy practices. Your interactions with third parties are at your own risk and subject to their terms and policies.
13. Disclaimers
The Site and Materials are provided “as is” and “as available”. To the fullest extent permitted by law, Treeside disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
- The Site will be uninterrupted, error-free, or secure
- Information will be accurate, complete, or current
- Any offer, quote, rate, approval, or outcome will be available or achieved
You assume all risk of harm to your device, software, data, or network from using the Site, interacting with advertisements, or downloading materials.
14. Limitation of liability
To the fullest extent permitted by law, Treeside and its owners, officers, directors, employees, contractors, and Associated Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business interruption, or other intangible losses arising from or related to your use of (or inability to use) the Site, Materials, or any third-party services.
If any liability is found notwithstanding the above, Treeside’s total liability for any claim will not exceed the greater of (a) the amount you paid to Treeside for the services at issue (if any) or (b) $100.
15. Indemnification
You agree to defend, indemnify, and hold harmless Treeside and its owners, officers, directors, employees, contractors, and Associated Parties from and against claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Site
- Your violation of these Terms
- Your violation of any law or the rights of any third party
- Any information you submit through the Site
16. Liquidated damages for certain unauthorized uses
Because unauthorized commercial use, copying, publishing, framing, or misuse of the Materials can cause harm that is difficult to quantify, you agree that, to the extent permitted by law, Treeside may seek liquidated damages of $100,000 per violation, plus actual damages, costs, and reasonable attorneys’ fees, for:
- Unauthorized commercial or public use of Site content
- Unauthorized copying, publishing, selling, or redistribution of Materials
- Unauthorized hyperlinking, co-branding, framing, mirroring, or embedding of the Site
This does not limit other remedies that may be available.
17. No right to additional notice
Unless required by law, you agree that no additional notice is required for any reason (including changes to these Terms), and you waive any right to additional notice as a condition of using the Site.
18. Dispute resolution; binding arbitration; class action waiver
Please read this section carefully. It affects your legal rights.
Agreement to arbitrate
You and Treeside agree that any claim, dispute, or controversy (whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory) arising out of or relating to the Site, these Terms, the Privacy Policy, communications (including marketing and solicitation), consumer report access, or any services provided (a “Claim”) will be resolved by binding arbitration, except where prohibited by law.
Arbitration procedures
- Arbitration will be administered under the rules of the American Arbitration Association (AAA) in effect when filed.
- The hearing will take place near Treeside’s principal business address, unless the parties agree otherwise.
- The arbitrator’s decision will be final and binding, with limited rights of appeal.
- The prevailing party may be entitled to reimbursement of reasonable costs and fees, as permitted by the arbitrator and applicable law.
No jury trial; no class actions
You and Treeside agree that:
- Claims will be brought only in an individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding.
- You waive the right to a jury trial.
Exceptions
Either party may seek relief in small claims court for eligible claims, or seek injunctive relief in court to stop unauthorized use of the Site or Materials, to the extent permitted by law.
19. Jurisdiction and venue for court proceedings
If any matter is properly brought in a court (including proceedings to enforce or confirm an arbitration award, or if arbitration is found unenforceable for a particular Claim), you agree that jurisdiction and venue will be in the state and federal courts located nearest to Treeside’s principal business address, unless applicable law requires otherwise.
20. Governing law
These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles, except to the extent federal law applies.
21. Severability
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
22. Entire agreement
These Terms, together with the Privacy Policy and any additional terms presented for specific features or services, constitute the entire agreement between you and Treeside regarding the Site and supersede prior or contemporaneous understandings.
